Artist Agreement

Welcome to StarStudio. This Artist Agreement (“Agreement”) governs the relationship between StarStudio (“Platform”, “Company”, “We”, “Our”, “Us”) and the artist, musician, producer, composer, lyricist, band, label, or other content owner (“Artist”, “You”, “Your”) who uploads or distributes content through the StarStudio platform.

By registering an artist account, uploading music, or using any artist-related services, you acknowledge that you have read, understood, and agreed to this Agreement.

1. Eligibility

To become an Artist on StarStudio, you must:

Be at least 18 years of age or have permission from a legal guardian.
Own or have the legal rights to distribute the uploaded content.
Provide accurate and complete account information.
Comply with all applicable laws and regulations.

StarStudio reserves the right to reject or suspend any artist account that fails to meet these requirements.

2. Ownership of Content

The Artist retains full ownership of all original music, lyrics, recordings, artwork, and related intellectual property uploaded to StarStudio.

Nothing in this Agreement transfers ownership of the Artist’s work to StarStudio unless expressly agreed in writing.

3. License Granted to StarStudio

By uploading content, the Artist grants StarStudio a non-exclusive, worldwide, royalty-free license to:

Host uploaded content.
Stream music on the platform.
Display album artwork.
Promote content through StarStudio services.
Index content for search.
Display previews and promotional materials.
Include content in playlists and recommendations.

This license exists only while the content remains available on StarStudio unless required by law.

4. Artist Responsibilities

The Artist agrees that:

All uploaded content is original or properly licensed.
No copyright, trademark, or intellectual property rights are violated.
Metadata is accurate.
Song titles, artist names, genres, and album information are correct.
Uploaded files meet StarStudio quality standards.

5. Prohibited Content

Artists may not upload content that:

Violates copyright laws.
Contains pirated material.
Impersonates another artist.
Includes illegal or offensive content.
Promotes violence, terrorism, or hate speech.
Contains malware or malicious files.
Uses fake streaming manipulation techniques.

StarStudio may immediately remove such content without prior notice.

6. Copyright Protection

The Artist confirms that they own all necessary rights to the uploaded content.

If copyright ownership is disputed, StarStudio may:

Remove the content temporarily.
Request ownership documentation.
Suspend distribution.
Permanently remove infringing material.
Suspend or terminate the responsible account.

7. AI-Generated Content

Artists may upload AI-assisted content only if they possess all required rights and permissions.

Artists remain fully responsible for ensuring that AI-generated material does not infringe upon the rights of any third party.

8. Music Publishing & Distribution

StarStudio may offer music publishing, digital distribution, and promotional services in the future.

Participation in such services may require additional agreements, revenue-sharing terms, or licensing conditions.

9. Royalties & Payments

If StarStudio introduces monetization, royalty distribution, or paid artist services in the future:

Payment terms will be published separately.
Royalties will be calculated according to the applicable program.
Taxes remain the responsibility of the Artist unless otherwise required by law.

10. Promotional Rights

The Artist authorizes StarStudio to:

Feature songs on the homepage.
Include music in curated playlists.
Use album artwork for promotional purposes.
Display artist profiles.
Promote content through social media, email campaigns, advertisements, and other marketing channels.

No ownership of the content is transferred through these promotional activities.

11. Content Removal

Artists may request removal of their content.

However, removal may not be immediate if:

Legal obligations exist.
Ongoing copyright investigations are in progress.
Distribution partners require additional processing time.

12. Account Suspension

StarStudio may suspend or terminate an Artist account if:

False ownership claims are submitted.
Fraudulent activities are detected.
Copyright infringement occurs.
Repeated violations of platform policies take place.
Illegal activities are discovered.

13. Limitation of Liability

StarStudio provides its platform on an “as available” basis.

While we strive to maintain reliable services, we do not guarantee uninterrupted availability, error-free operation, or compatibility with every device.

To the maximum extent permitted by applicable law, StarStudio shall not be liable for indirect, incidental, consequential, or special damages arising from the use of the platform.

14. Privacy

Artist information is processed according to the StarStudio Privacy Policy.

Personal information will be handled securely and in accordance with applicable privacy laws.

15. Changes to this Agreement

StarStudio may update this Agreement from time to time.

Material changes will be published on the website, and continued use of the platform after such updates constitutes acceptance of the revised Agreement.

16. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of the Republic of India.

17. Dispute Resolution

Any dispute arising from this Agreement shall first be resolved through good-faith discussions.

If unresolved, the dispute shall be referred to arbitration in accordance with the applicable laws of India. The courts having jurisdiction over StarStudio’s principal place of business shall have exclusive jurisdiction where arbitration is not applicable.

Acceptance

By creating an Artist account, uploading music, or using any artist services offered by StarStudio, you confirm that you have read, understood, and agreed to this Artist Agreement.
